Digital Rights: How to be sure you have the rights to use existing material

Whether you are creating digital content from scratch, or re-imagining work for an online audience, you may want to incorporate material created by someone else, and that includes making sure you have the rights to use it.

In this session we focus on what’s involved in securing digital rights to visual, artistic and text-based material: from a YouTube clip or a photo or graphic on Instagram, to a passage from a book or material from a stock library.

We consider how you go about clearing the rights to existing works, what you need to think about, and how to think about possible options and alternatives.

Fiona Morris, Chief Executive and Creative Director of The Space

Fiona is a music and arts producer with over 25 years’ experience producing and commissioning programmes. Her production credits including performance, documentary and entertainment programmes that have received Prix Italia, Emmy, Grammy and BAFTA awards.

Gill Davies

Gill Davies is a multimedia producer – she works with audio, video, web and text, across radio, podcasts, TV and the arts, and in music and live performance. Her clients and collaborators include the BBC, National Galleries of Scotland, Hebrides Ensemble, Edinburgh Napier University, Glasgow Caledonian University and Glasgow City Council.  Gill also brings an editorial perspective on rights, as previous roles include a stint as Editor of BBC Scotland’s New Media Department.

Jamie Smith

Jamie is a Partner and Co-Head of the Interactive Group at media and technology law firm Sheridans, focusing on digital content, gaming, animation, AR/VR and digital/interactive media. Previously at The Mill and Sony Playstation among others he has great experience and insight in areas including Contract Law, Game Development, IP/IT, Data Privacy and Software Licensing.  

Stephen Bergson

Archive researcher Steve Bergson. Steve has worked extensively in TV, film, online publishing and video games. Steve will discuss the ways he works to identify and clear rights for existing material, whether that’s contemporary or archive footage, graphics, images or text. He’ll also highlight examples of creative workarounds and alternatives where clearance is unfeasible or unavailable.
